A jury in Bangor, Maine has awarded $6.7 million to a woman
whose husband died at Eastern Maine Medical Center after an ATV accident.
According to court documents, 49 year-old Paula Braley filed
a medical malpractice lawsuit against Eastern Maine Medical Center over the
2005 death of her husband, Thomas Braley Sr. The lawsuit alleged that doctors
at the hospital failed to follow up on a CT scan that indicated Thomas Braley
had internal bleeding.
Paula Braley claimed that the internal bleeding caused one
of Braley’s lungs to collapse, leading to a fatal heart attack. A Penobscot
County jury found in favor of the plaintiffs on Monday and returned a verdict
of more than $6.7 million.
Braley’s attorney said the award will likely be reduced
because damages for conscious suffering and loss of companionship have been
capped by the state Legislature.
