A Jefferson County Grocery store has agreed to pay anundisclosed amount of money to settle a slip and fall lawsuit filed last year.
According to court documents, Jefferson County-residentEarlene Steward sued H-E-B Grocery in September 2010 claiming she slipped andfell on an unidentified liquid substance that had pooled near the store’s entrance.She claims she was shopping at the grocery store on June 5 when she “slipped ina liquid substance on the floor of the defendant’s premises.” The lawsuit saidStewart was “exercising reasonable care for her own safety,” and that theliquid “posed an unreasonable risk of harm.”
Stewart alleged that because H-E-B negligently failed tomaintain its premises in a safe condition, she seriously injured her shoulder,wrist, hip, back and spine.
H-E-B denied Stewart’sallegations and claimed the incident was caused by a third party or her ownnegligence.
Mediator JamesMehaffy filed a letter with a Beaumont judge last week stating that bothparties had reached a settlement agreement.
