Mitsubishi Motors North America has been named in a lawsuit stemming from the death of a New Hampshire teen in a rollover accident.
According to Salem Superior Court documents, Charles and Michelle Foster have filed a lawsuit against the automaker which claims the Mitsubishi Montero SUV is "unreasonably dangerous." The lawsuit alleges the Montero's design is to blame for the death of the plaintiffs' 17 year-old Son, Jason.
Jason Alan Foster was one of two people who were killed in a rollover accident in Salem, N.H., on August 6, 2009. Foster and a 16 year-old girl were in the back of the Montero when the driver lost control of the vehicle and rolled over on a curve. Foster and the girl were both ejected from the vehicle and killed.
The Fosters' attorney, Joseph Balliro Jr., says the Mitsubishi Montero is "notorious" for rollover accidents, due to a major design flaw. Balliro says a number of lawsuits have been filed across the country alleging that the Montero SUV is top-heavy and prone to rollover.
