On Easter Sunday 2007, 50-year old Penny Sue Thomson was driving through Forth Worth, Texas. Also in the car were her six year old granddaughter and ten year old grandson. As they passed through an intersection, 53 year old Larry Dean Roberts, who was driving a tractor trailer, failed to observe a stop sign and collided with Thomson’s vehicle. Thomson and her granddaughter will killed, while her grandson sustain serious injuries.
On August 11, 2008, the parents of the injured children settled out of court with Joe Swinson of Swinson Excavating, Stoney Point Agricorp., Inc. The parents, Corey and Lisa Moore, had filed wrongful death and serious injury lawsuits against Roberts’ employer. They received $5.1 million in the settlement.
